Mindbloom Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy (“Health Data Policy”) describes how Mindbloom, Inc. (“Mindbloom,” “we,” “us,” or “our”) processes “Consumer Health Data,” as that term is defined under applicable state privacy law, about consumers who reside in the states of Nevada, Washington, and any other applicable U.S. jurisdiction in connection with our Site and Service, as defined in our Privacy Policy. Please carefully read this Health Data Policy as it contains important information concerning your Consumer Health Data and how we use it.
Depending on your relationship with us, some of the personal information that we collect about you may identify your past, present, or future physical or mental health status (“Consumer Health Data”). This Health Data Policy relates only to Consumer Health Data. This Health Data Policy does not describe how we process your personal information. For more details about our information practices with respect to personal information, please refer to our Privacy Policy. Please also note that some uses of the Service may be subject to other state laws, as discussed in our Privacy Policy.
We may collect the following categories of Consumer Health Data:
- Individual health conditions, treatment, diseases, or diagnoses;
- Social, psychological, behavioral, and medical interventions;
- Health-related surgeries or procedures;
- Use or purchase of prescribed medications;
- Bodily functions, vital signs, symptoms, or measurements;
- Diagnosis or diagnostic testing, treatment, or medication;
- Reproductive or sexual health information;
- Information that could identify your attempt to seek health care services;
- Any inferences based on the above categories or derived or extrapolated from non-health information, such as cookies and other tracking technologies, that identify your past, present, or future physical or mental status.
We may collect Consumer Health Data from the following categories of sources:
- Directly from you when you share it with us, for example, when taking our initial candidate survey;
- From third parties that may be involved with your use of the Service, such as counselors, clinicians, and other professionals from our affiliated medical group; and
Through our third-party service providers that support the Service. This may include the use of cookies, pixels, web beacons, and similar technologies to collect information about you over time and across different websites, including the Services. Please note that we do not “sell” Consumer Health Data, as defined under applicable law.
We may collect, processes, and disclose Consumer Health Data for the following business purposes:
Service delivery. This includes:
- provide, operate, protect, update, analyze, and improve the Service and our business
- establish and maintain your user profile on the Service
- process the purchase of services that are placed through the portal
- communicate with you about the Service, including by sending announcements, updates, security alerts, and support and administrative messages
- understand your needs and interests, and personalize your experience with the Service and our communications
- provide support for the Service and respond to your requests, questions, and feedback
- develop and operate AI tools, as described in more detail in our Privacy Policy.
Compliance and protection. This includes:
- comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities; to verify or enforce our agreements, terms of use, or other applicable policies; to respond to an emergency; or otherwise to protect the rights, property, safety, or security of Mindbloom, visitors to our Service, or the public, as required or permitted by law
- audit our internal processes for compliance with legal and contractual requirements and enforce the terms and conditions that govern the Service
- prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activity, including cyberattacks and identity theft
Creating anonymized, pseudonymized, aggregated, or de-identified information. Your Consumer Health Data may be anonymized, pseudonymized, aggregated or de-identified by removing data components (such as your name, email address, or linkable tracking identifier) that makes the data personally identifiable to you. We do this for our business operations, to disclose to other parties for our lawful business purposes, and for research and development of new products or services.
We may disclose some or all of the above categories of Consumer Health Data for the purposes described above with the following third parties and affiliates:
- Healthcare parties. This includes the Affiliated Medical Groups (Mindbloom Provider Group, P.A., Mindbloom Medical, P.C., Mindbloom Medical KS, P.A., Mindbloom Medical NJ, P.C., and Mindbloom Medical Group of CA, P.C.) and other entities that assist with treatment, payment, and other operations so that they can deliver healthcare services to you and conduct related processing and billing functions.
- Service providers. We work with organizations that provide services on our behalf or help us operate the Service or our business (such as hosting, maintaining, and improving our information systems, customer support, fulfilling orders, payment processors, email delivery, and website analytics). Mindbloom’s service providers include organizations that may process data that we collect or that is collected for us at our request. When contracting with our service providers and implementing their services, we take reasonable steps to help ensure that these service providers are not permitted to disclose, use or share any identifiable data except as necessary to support our processing activities or as otherwise permitted or required under law.
- Business partners. Parties with whom we collaborate on joint activities, with whom we have entered into marketing relationships or affiliate relationships who may offer, recommend, or advertise our Service to you with your appropriate consent or authorization as required under applicable law.
- Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.
- Authorities and others. Law enforcement and government authorities that are necessary or appropriate for the compliance purposes described above.
- Business transferees. Acquirers and other relevant participants in business transactions (or negotiations and diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Mindbloom or our affiliates (including, in connection with a bankruptcy or similar proceedings).
- Authorized or Requested by You. We may also disclose your Consumer Health Data to entities or individuals you authorize us to share certain information with.
Your Privacy Rights
Depending on your place of residency, you may have some or all of the following rights regarding your Consumer Health Data, subject to applicable law and certain exceptions:
- Right to Confirm and Access: If you ask us, we will confirm whether we are collecting, sharing, or selling your Consumer Health Data. At your request, we will provide a list of all third parties and affiliates with whom we have shared or sold your Consumer Health Data. You may request that we provide you with a copy of the Consumer Health Data that we maintain about you.
- Right to Correct: If your Consumer Health Data that we maintain is inaccurate and you would like us to correct it, you may request that we make changes to it.
- Right to Withdraw Consent or Authorization: Where we have relied on your consent or authorization for certain processing of your Consumer Health Data, you may withdraw that consent or authorization at any time.
- Right to Delete: You may request that we delete Consumer Health Data that we maintain about you.
- Right to Appeal: If we deny your request to exercise any of the above rights, you may request to appeal this decision.
To exercise any of the above rights, you or your authorized agent may do so by following instructions in “Contact Us” below or following the links in the Privacy Policy. In order to process your request, we may ask you to verify your identity by confirming your name, e-mail address, phone number, or other identifiable information that we have in our records, such as most recent interaction with us, if applicable.
Updates to this Policy
We reserve the right to modify this Health Data Policy at any time. If we make material changes to this Health Data Policy, we will notify you by updating the Health Data Policy date and posting it on the Service or as otherwise required by law. Modifications to our Health Data Policy are effective as of the date on the Health Data Policy. Your use of the Service after the effective date of any modified Health Data Policy indicates your acceptance of the information contained in the modified Health Data Policy.
